I choose to participate in classes, performances, workshops, and other activities at ThruDance (the “ThruDance Activities”) of my own free will and hereby certify that I am in proper physical condition to take part in such Activities.
Risks
I understand that there are risks of physical injury associated with, arising out of, and inherent to dancing and my participation in the ThruDance Activities. These risks include the potential for slips and falls, sprains, strains, dislocations, soft tissue injuries, musculoskeletal injuries, podiatric conditions, and other risks not specified here. Understanding these risks and the potential for others not listed, I agree to personally accept and assume all of the risks present in my participation in the ThruDance Activities. My participation at ThruDance is entirely voluntary, and I choose to participate in spite of the risks.
Liability Waiver
By signing this Liability Waiver and Film and Photography Release (“Waiver and Release”), I hereby release ThruDance, its directors, owners, students, teachers, instructors, staff, employees, volunteers, associates and agents (collectively, “ThruDance”) and any leaseholder, landlord or owner of the ThruDance Studio facility (“Studio”), from any liability or claim that I or my guests or representatives may have with respect to any bodily injury, personal injury, illness, death, or property loss or damage that may arise before, during or after my participation in the ThruDance Activities. I voluntarily release and forever discharge and hold harmless ThruDance and the Studio from any and all claims or demands for damages, loss of services, costs and expenses, injuries, attorney fees, and any other call for reparation from any and all injury to me or my property arising in any way from the ThruDance Activities and my use of ThruDance equipment or facilities.
Film and Photography Release
I understand and agree that ThruDance may take photo and video recordings of me during my participation in any ThruDance Activities and in the Studio, including without limitation photographs and videos of my likeness, voice, name, photographs, video and or images, in whole or in part or distorted in character form, either alone or accompanied by other material (collectively, the “Recordings”). I hereby grant ThruDance and its designees, the absolute right and permission to film and photograph me and I hereby convey to ThruDance full ownership, rights and interest in the Recordings, and understand that the Recordings may be used throughout the world in perpetuity and royalty free in advertising, promotion, publicity, marketing and or other trade materials relating to ThruDance, including in any physical or virtual media now known or developed in the future. I waive all rights to compensation for use of the Recordings and all rights to inspect and approve any such Recordings. I agree not to hold ThruDance responsible for any liability resulting from the use of the Recordings, including but not limited to claims for defamation or right of privacy.
